For the last 60 days(technically he only had 30 days in my state) I have been chasing him to get the security deposit back. Just yesterday I got an email -in it he stated that -
a. the rugs were entirely ruined by my dogs and needed to be replaced (they were at least 10 yrs old-and I shampoo’ed them several times prior to leaving and although in rough shape as they were when i moved in -NOT destroyed)
b. Several screens were missing from the windows ( most were already missing prior to my moving in and he knew this )
c. The refrigerator was destroyed and needed to be replaced (also at least 10 years old and was fully working and good when I left)

He has told me the damage far exceeds the deposit and has been a bit threatening about legal suite.

In all fairness I can understand losing some of my deposit for professional cleaning as he has to get it "selling ready". But my issue is that NONE of this came to be until he got the house under agreement and told me that he has to get all this fixed PRIOR TO CLOSING.

I dont want to go to court- but what information can I use for him to stop trying to fleece me for more money?

Based on what you have said he has no right to keep the money apart from prehaps the cleaning fee.

Try and nip it in the butt now and go and get a solicitor to write a letter to him asking for your deposit back less reasonable cleaning costs.

If you don’t want to do that then do what most big companies do when they receive complaints, ignore what he has said and send a very polite email back detailing the state of the property when you arrived, details as to what you had original flagged up and a request for the deposit less cleaning fee’s back. (ideally send a copy by letter)

Add a little section at the end noting his concerns and stating that you hope you can resolve the matter between the 2 of you amicably but if you don’t receive the funds within 28 days you will have to take legal action.

I personally would just go straight to solicitor and then court, but if you are happy to give up the deposit then that last paragraph should hopefully make him think twice. Basically be polite and unemotional but don’t give him the money.
